国(境)外学历学位认证失信行为公示办法 (中/EN)(2018年12月20日-2023年01月27日适用)

  第一章 总则

  第一条 为规范国(境)外学历学位认证失信行为,推进社会信用体系建设,根据相关法律法规及政策的规定,特制定国(境)外学历学位认证失信公示办法(以下简称“本办法”)。

  第二条   国(境)外学历学位认证评估机构(即教育部留学服务中心,以下简称“留服中心”)依据《国(境)外学历学位认证评估办法》,以及与申请人签订的《国(境)外学历学位认证服务使用协议》等,对失信行为进行认定与处理,并根据本办法,决定是否将失信人列入失信行为公示名单(以下简称“失信名单”)。

  第三条   留服中心公示失信行为信息,遵循客观公正、程序正当的原则。

  失信名单应客观、准确、公正,保证公布信息的合法性、真实性、准确性。

  第四条   申请人在学历学位认证过程中的合法权益依法受到保障;对失信公示不服的,依法享有提出异议、申请复核等权利。

  第五条   留服中心依法建立失信主体信息共享制度,依托全国信用信息共享平台,与相关政府部门、司法机构或社会征信机构共享相关信息。

  第二章 失信名单公示与共享

  第六条 本办法所称失信行为,是指申请人在学历学位认证申请过程中提供虚假国(境)外学历学位证书或其他虚假材料、不实信息,以骗取学历学位认证的不正当行为。

  第七条   申请人存在失信行为的,留服中心可以在作出不予认证或撤销认证决定时,决定是否将其列入失信名单,并在《不予认证通知单》或《撤销认证通知单》中一并告知。

  申请人对被列入失信名单的决定不服的,可以自收到不予认证通知单或撤销认证通知单之日起,或者未收到通知单自知道或应当知道之日起10个工作日内,向留服中心提出异议。10个工作日内对公示决定未提交书面异议,留服中心将其列入失信名单。留服中心收到异议之日起3个工作日内组织复核。经复核仍未改变原认证结果的,留服中心可将相应主体列入失信名单。

  申请人对复核决定有异议提起诉讼的,不影响复核决定的有效性。

  第八条  申请人被告知将其列入失信名单时为未成年人的,将不被列入失信名单。

  第九条   申请人被列入失信名单的,在中国留学网公示的期限为三年,自公示之日起计算。

  申请人存在失信行为,并造成严重社会影响,或者以不正当手段获得认证后招摇撞骗,造成严重社会影响的,留服中心可视具体情况决定延长公示期一至三年。

  第十条   留服中心定期在中国留学网与全国信用信息共享平台向社会公示失信名单,必要时也可通过报纸、广播、电视等其他方式予以公布,并将失信信息永久保存于留服中心认证系统、档案库。

  第十一条   记载和公布的失信名单信息可包括:

  (一)中国籍申请人的姓名、性别、出生日期、认证结果编号、身份证号码或其他依法可以用于证明身份的证件号码;

  (二)外籍申请人的姓名、性别、出生日期、认证结果编号、所提交护照号码或其他依法可以用于证明身份的证件号码;

  (三)申请人失信行为的具体情形、依据;

  (四)列入失信名单的时间;

  (五)留服中心认为应当记载和公布的不涉及个人隐私的其他事项。

  留服中心在《国(境)外学历学位认证服务使用协议》中申明失信行为将导致的后果,并获得依法公示公开失信信息的授权。

  第十二条   留服中心按照国家有关规定,与相关部门共享失信名单。

  留服中心可以将失信名单信息,向政府相关部门、司法机关、金融监管机构、金融机构、承担行政职能的事业单位及行业协会等通报,供相关单位依照法律、法规和有关规定,在政府采购、招标投标、行政审批、政府扶持、融资信贷、市场准入、资质认定、评优表彰、生活消费等方面,对失信主体予以信用约束或信用惩戒。

  第十三条   留服中心可将失信名单信息向有关部门、企事业单位提供,供其在招聘录用、职称评定、评优表彰、科研活动等方面作为重要考量因素。

  第十四条   留服中心可以将失信名单信息向征信机构通报,并由征信机构在其征信系统中记录。

  第十五条   国家工作人员、人大代表、政协委员等被列入失信名单的,留服中心可将失信情况通报其所在单位和相关部门。

  第三章   失信名单管理

  第十六条   留服中心应及时更新失信名单信息。

  记载和公布的失信信息不准确的,留服中心应在确认后的3个工作日内予以变更。

  第十七条   申请人满足下列条件之一的,留服中心应在10个工作日内,将其移出失信名单:

  (一)公示期限届满的;

  (二)申请人死亡,其亲友向留服中心提出书面申请移出的;

  (三)申请人提起诉讼,法院裁定或判决移出失信名单的;

  (四)依职权或依申请发现不应列入失信名单的;

  (五)作为列入名单依据的法律法规或政策性文件嗣后发生变化,已无惩戒必要的;

  (六)失信情节轻微,申请人积极主动纠正失信行为,并消除或减轻危害后果,经审核同意将其移出名单的;

  (七)其他应移出失信名单、删除失信信息的情形。

  第十八条   申请人同时具有下列行为的,可以认定为主动纠正失信行为:

  (一)主动配合留服中心工作,积极消除危害后果,态度诚恳的;

  (二)及时更正虚假材料或不实信息的。

  第十九条  被列入失信名单的自然人认为有下列情形之一的,可以向留服中心申请纠正:

  (一)不应将其列入失信名单的;

  (二)记载和公布的失信信息不准确的;

  (三)失信信息应予删除的。

  第二十条   自然人对被列入失信名单申请纠正的,留服中心应自收到书面纠正申请之日起10个工作日内组织审查,经审查理由成立的,将在确认后的3个工作日内纠正;理由不成立的,决定驳回。自然人对驳回决定不服的,可以自决定书送达之日起向人民法院提起诉讼。

  诉讼期间,不停止列入失信名单决定的执行。

  第四章 附则

  第二十一条   本规定所称申请人是指向留服中心提起学历学位认证申请的,或已经取得学位学历认证结果,因发现存在失信行为而被留服中心撤销认证的自然人。

  第二十二条   本规定所称送达之日,是指:

  (一)邮寄送达的,是指受送达人或者指定代收人在邮件签收单上签收之日;没有邮件签收单的,为受送达人或者指定代收人在送达回执上签名之日;

  (二)依法通过公告形式告知受送达人的,是指公告规定的期限届满之日;

  (三)经受送达人同意,以手机短信、传真、电子邮件等能够确认其收悉的方式送达的,是指手机短信、传真、电子邮件等到达受送达人特定系统之日;

  (四)以其他合法方式告知受送达人的,为受送达人知道或应当知道该决定书之日。

  受送达人或代收人拒绝签收或者下落不明的,应公告送达。

  以公告形式送达的,应在中国留学网主页公告,且公告期不少于45日,并注明原因。

  第二十三条   与本办法有关的咨询与沟通渠道在中国留学网公布。

  第二十四条   本办法由留服中心负责解释。

  第二十五条   本办法自发布之日起施行。

Publicity Method for Dishonest Behavior in Overseas Credential Evaluation Service

  Chapter I       General Provisions

  Article 1 In order to standardize the dishonest behavior in Overseas Credential Evaluation and promote construction of the social credit system, the Publicity Method for Dishonest Behavior in Overseas Credential Evaluation Service (the “Method”) is formulated in accordance with the provisions of relevant laws, regulations and policies.

  Article 2 The overseas credential evaluation authority, i.e. the Chinese Service Center for Scholarly Exchange (the “Service Center”), identifies and handles the dishonest behavior in accordance with the Provisions on the Evaluation of Overseas Credentials, the Overseas Credential Evaluation Service User Agreement signed with the applicants and so on, and decides whether to include dishonest people in the Publicity List for Dishonest Behavior (the “List for Dishonesty”) based on the Method.

  Article 3 The publicity of dishonest behavior information by the Service Center must follow the principles of objectivity, fairness, and due procedures.

  The List for Dishonesty shall be objective, accurate and fair, and guarantee the legality, authenticity and accuracy of information published.

  Article 4 The legitimate rights and interests of applicants in the process of Credential Evaluation should be protected according to law, and those who are dissatisfied with the publicity of dishonesty have the right to raise an objection, apply for review and so on according to law.

  Article 5 The Service Center attends to the subjects of the dishonesty information sharing system according to law, and shares relevant information with related government sectors and judicial organs or social credit agencies depending on the nationwide credit information sharing platform.

  Chapter II      Publicity and Sharing of List for Dishonesty

  Article 6 The dishonest behavior mentioned in the Method refers to improper conduct in which an applicant provides false overseas certificates or other false materials and incorrect information during his/her applying for credential evaluation, so as to gain credential evaluation by cheating.

  Article 7 When an applicant behaves dishonestly, the Service Center may decide whether to include the applicant in the List for Dishonesty when making the decision of evaluation refusal or withdrawal , and shall notify the applicant with a Notice of Evaluation Refusal or a Notice of Evaluation Withdrawal.

  An applicant who is dissatisfied with the decision of being included in the List for Dishonesty may raise an objection to the Service Center from the date when the Notice of Evaluation Refusal or the Notice of Evaluation Withdrawal is received or within ten working days from the date when such applicant is or should be aware of the Notice if the Notice is not received. If a written objection to the decision publicized is not submitted within ten working days, the Service Center will include such applicants in the List for Dishonesty. The Service Center will organize review within three working days of when the objection is received, and may include the involved subjects in the List for Dishonesty if the original evaluation result is still unchanged after evaluation review.

  An applicant’s filing of a suit against the decision made through evaluation review shall not affect the validity of that decision.

  Article 8 The applicant who is a minor when he/she is notified that they are eligible to be included in the List for Dishonesty will not be included in the List for Dishonesty.

  Article 9 The term of publicity of applicants included in the List for Dishonesty on www.cscse.edu.cn is three years calculated from the date of publicity.

  When an applicant behaves dishonestly or cheats and bluffs after getting evaluation results by improper means, causing serious social influence, the Service Center may decide to extend the term of publicity by one to three years at its discretion.

  Article 10 The Service Center should publicize the List for Dishonesty at www.cscse.edu.cn and a nationwide credit information sharing platform on a regular basis, and may publish the List for Dishonesty by newspapers, radio, television or other means when necessary, and will permanently save dishonesty information in its evaluation service system and archives.

  Article 11 The recorded and published information of the List for Dishonesty may include:

  (1) A Chinese applicant’s name, gender, date of birth, evaluation result No., ID card No. or other ID numbers that can be used for proving his/her identity according to law;

  (2) A foreign applicant’s name, gender, date of birth, evaluation result No., submitted passport No. or other ID numbers that can be used for proving his/her identity according to law;

  (3) Specific situation and basis of applicant’s dishonest behavior;

  (4) Time when he/she was included in the List for Dishonesty;

  (5) Other matters not involving personal privacy that the Service Center deems should be recorded and published.

  The consequences declared by the Service Center in the Overseas Credential Evaluation Service User Agreement that dishonest behavior will lead to, and the obtainment of authorization to publicize and publish dishonesty information according to law.

  Article 12 The Service Center will share the List for Dishonesty with relevant departments according to the relevant regulations of the country.

  The Service Center may inform related government departments, judicial organs, financial regulators, financial institutions as well as public institutions and industry associations undertaking administrative function of information about the List for Dishonesty, so that units concerned can render credit constraints or punishments to the subjects of dishonesty with respect to government procurement, tendering and bidding, government review and approval, government support, financing and credit, market access, qualification accreditation, excellence selection and commendation, living consumption and other aspects pursuant to laws, regulations and relevant provisions.

  Article 13 The Service Center may provide related departments, enterprises and public institutions with information about the List for Dishonesty, so that they can use it as an important consideration in terms of recruitment and employment, professional title appraisal, excellence selection and commendation, scientific research activities, etc.

  Article 14 The Service Center may give information about the List for Dishonesty to credit reporting agencies which may record such information in their credit reporting systems.

  Article 15 If national staff, deputies to the people's congress, CPPCC members et al. are included in the List for Dishonesty, the Service Center may notify involved units and related departments of that fact.

  Chapter III    Management of List for Dishonesty

  Article 16 The Service Center shall update the information about the List for Dishonesty from time to time.

  In case of inaccurate dishonesty information recorded and published, the Service Center shall alter such information within three working days upon confirmation.

  Article 17 If an applicant satisfies one of the following conditions, the Service Center shall remove the applicant from the List for Dishonesty within ten working days:

  (1) The term of publicity expires;

  (2) The applicant’s relatives or friends apply to the Service Center in writing for removal from the List for Dishonesty due to his/her death;

  (3) The applicant filed a suit, and the court ruled or decided that such applicant could be removed from the List for Dishonesty;

  (4) It is found that the applicant shouldn’t be included in the List for Dishonesty ex officio or according to the application;

  (5) Laws and regulations or policy documents used as the basis for inclusion in the List for Dishonesty have changed and thus there is no need for punishment;

  (6) The applicant positively and actively corrected his/her dishonest behavior and eliminated or mitigated harmful consequences in case of minor offenses, and has been approved to be removed from the List for Dishonesty upon review;

  (7) Other circumstances that the applicant should be removed from the List for Dishonesty and his/her information of dishonesty deleted.

  Article 18 If an applicant conducts the following behaviors at the same time, such applicant can be deemed to have actively corrected his/her dishonest behavior:

  (1) Actively supporting the work of the Service Center, positively eliminating harmful consequences, and being sincere;

  (2) Timely correcting false materials or incorrect information.

  Article 19 If one natural person included in the List for Dishonesty considers that one of the following circumstances exists, they can apply to the Service Center for correction:

  (1) The individual shouldn’t be included in the List for Dishonesty;

  (2) The recorded and published dishonesty information is inaccurate;

  (3) The dishonesty information should be deleted.

  Article 20 If any natural person applies for correction of the information included in the List for Dishonesty, the Service Center shall organize review within ten working days from when the written application for correction is received, and correct the information within three working days upon confirmation if the causes are established through review, which it will not do if the causes are not established. If the natural person is dissatisfied with the decision on refusal, they may file an appeal to the people’s court from the date of service of the Letter of Decision.

  The execution of decision on inclusion in the List for Dishonesty shall not be stopped during the period of litigation.

  Chapter IV    Supplementary Provisions

  Article 21 The applicant as mentioned in these Stipulations refers to a natural person who has applied to the Service Center for credential evaluation or obtained the result of credential evaluation and whose evaluation result is withdrawn by the Service Center because they are found to have behaved dishonestly.

  Article 22 The date of service as mentioned in these Stipulations refers to:

  (1) The date of signing of a mail form by recipient of the service or designated receiver in case of service by mail; the date of signing of a service return receipt by recipient of the service or designated receiver if there is no mail signature form;

  (2) The date when the period specified in the announcement expires in case of notifying the recipient of the service in the form of announcement according to law;

  (3) The date when short message service, fax, e-mail or other means is sent to the specific system of the recipient of the service in case of service by short message service, fax, e-mail or other means whose receipt can be confirmed with the consent of such recipient;

  (4) The date on which the recipient of the service is or should be aware of such Letter of Decision in case that the recipient of the service is notified by other legitimate means.

  If the recipient of the service or the receiver refuses to sign or is missing, service shall be given by announcement.

  Announcement shall be issued on the homepage of www.cscse.edu.cn in case of service in the form of announcement, and the announcement period shall be no less than 45 days, and reasons shall be indicated.

  Article 23 The consultation and communication channels associated with the Method will be published on www.cscse.edu.cn.

  Article 24 The Method shall be interpreted by the Service Center.

  Article 25 The Method shall come into force from the date of release.
